These Terms of use apply to your use of www.otto.hk service. By using www.otto.hk service, you agree to be bound by these Terms of use.
1. Access and use: You may access and make personal domestic use of the www.otto.hk service. You may not reproduce, duplicate, copy, sell, resell, use or exploit the www.otto.hk service or any of its contents or products for any commercial purpose. You must not use www.otto.hk service in any way that causes, or is likely to cause www.otto.hk service or access to it to be interrupted, damaged or impaired in any way. You must not use www.otto.hk service for fraudulent purposes or in connection with a criminal offence, a civil wrong or other infringing or unlawful activity. www.otto.hk service is intended for use by customers ordering products or services in Hong Kong and such other countries as permitted by us in the future, and not for those persons who do not have the required capacity to enter into legally binding contracts with us or Supplier (as the case may be).
2. Purchases: When you place an order to purchase a product or service from www.otto.hk service, we will send a confirmation through your registered email address and/or your registered mobile telephone number, confirming receipt of your order and containing the details of your order. Your order is an offer to us or Supplier (as the case may be) to purchase a product or service which is accepted by us or Supplier when this confirmation is sent.
3. Payment and pricing: By entering your user name and login ID on www.otto.hk and ordering products or services through www.otto.hk service, you authorise us or Supplier (as the case may be) to charge your designated credit card for the full amount of the products or services ordered and all related fees and charges. Unless otherwise provided in the terms of supply imposed by Supplier, all prices are quoted in Japanese Yen and include Japanese VAT (with prices in Hong Kong Dollar and US Dollar as indicative references only) and are subject to change from time to time without prior notice. Pricing or typographical errors may occur and in the event that an item is listed at an incorrect price, we shall have the right in our sole discretion to decline or cancel any orders placed for that item, or to contact you for purchase instructions based on the correct price information. Products and services purchased by you via www.otto.hk service shall be paid for in Japanese Yen by a valid and authorised credit card, unless otherwise stipulated by us.
4. Delivery and return: Please review our Delivery policy which applies to products purchased from www.otto.hk service.
5. Your user name and login account: You will be asked to create a user name and login account through www.otto.hk. You are responsible for maintaining the secrecy of your account and password to prevent unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or password. You also agree that your use of your password will be to identify yourself and indicate your authorisation or approval of the information to which the use of your password relates. You must inform us immediately if you have any reason to believe that your password has become known to anyone else, or if your password is being, or is likely to be, used in an unauthorised manner. We reserve the right to accept or reject your account application and/or to suspend the use of or terminate your account with or without cause or notice.
6. Privacy: Please read our Privacy Policy to understand our policies and practices regarding collection and retention of your personal data, the purposes for which your personal data may be used and the classes of persons to whom your personal data may be transferred. We may share your personal data for the purpose of processing your www.otto.hk service transactions with Supplier who have established policy and practice in relation to handling of personal data received from us.
7. Electronic communications: We may communicate with you by posting notices to your registered email account. You agree that all agreements, notices and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
8. Liability: In connection with your use of www.otto.hk service and the supply of products, services and information purchased or obtained through www.otto.hk service: (a) we and our affiliates exclude all implied warranties, conditions and obligations and all indirect losses or liabilities for Supplier's products, services and transactions to the fullest extent permitted by law; and (b) our total liability to you shall be limited, at our option, to repairing the product, re-supplying the product or service again or paying the cost of having the product or service re-supplied, and shall not in any event exceed the total amount paid by you for the product or service
9. Alteration of service or amendments to the conditions: We reserve the right to make changes to www.otto.hk service, these Terms of use and all related policies and notices at any time. You will be subject to the Terms of use and all related policies and notices in force at the time you use www.otto.hk service or when you order products or services from www.otto.hk service. If any provision of these Terms of use or related policies or notices is deemed invalid, void, or for any reason unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
10. Causes beyond our reasonable control: We will not be held responsible for any delay or failure to comply with our obligations if the delay or failure arises from any cause, which is beyond our reasonable control.
11. Governing law and jurisdiction: These Terms of use are governed by and construed in accordance with the laws of the Hong Kong SAR. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong SAR.
12. Miscellaneous: The English version of these Terms of use shall prevail over the Chinese version (if any). References to "we", "us" and "our" are references to Otto Japan Inc. References to "Supplier" are references to any third party supplier of goods or services from whom you may purchase goods and/or services through www.otto.hk service in accordance with these Terms and Conditions.
